Touch Stay Referral Program T&Cs — Hosts
These terms bind a Touch Stay account holder who takes part in the Touch Stay Referral Program. They do not amend the general Touch Stay Terms and Conditions, which continue to apply to every host account.
A guest who shares a referral link accepts a separate set of terms, the Touch Stay Referral Program Terms and Conditions for Guests.
1. The Program
1.1 The Touch Stay Referral Program (the "Program") is operated by Touch Stay. Touch Stay is owned and operated by JAM Start Ltd, a company incorporated in England and Wales with company number 09352517. A term defined in the general Touch Stay Terms and Conditions has the same meaning here.
1.2 The Program runs two tracks. Under the host track, a host refers a new host to Touch Stay. Under the guest track, a guest of the host's guidebook refers a new host to Touch Stay, and the host shares in the reward. Touch Stay may run either track without the other.
1.3 The host accepts these terms by generating or sharing a referral link, or by switching the guest track on. A host on the Free plan cannot switch the guest track off, and accepts these terms on selecting the Free plan.
1.4 The Program runs alongside the Touch Stay affiliate program at touchstay.com/refer, which has its own terms.
1.5 A prize draw or raffle is a separate promotion with its own terms and is not governed by this document.
2. Eligibility
2.1 A host must be 18 or older to earn a reward.
2.2 Employees and contractors of Touch Stay and of itrinity, and their immediate families, are not eligible to earn a reward.
2.3 Participation is void where local law prohibits it.
3. What qualifies
3.1 A referral qualifies only when the referred person becomes a paying Touch Stay customer. Both of the following are required:
- the referred person creates a new Touch Stay account using the referral link, and verifies their email address; and
- that account converts to a paid Touch Stay subscription.
3.2 Signing up, starting a trial and using the Free plan do not qualify. No reward is earned at those stages.
3.3 The referred person must be a new Touch Stay customer. An existing account holder, a reactivated account, and an account materially controlled by the host do not qualify.
3.4 Attribution must be established by Touch Stay's systems at the moment the referred person converts. Where a referral cannot be attributed at that moment, no reward is due.
3.5 Where the referred person's payment is refunded, charged back or reversed, Touch Stay may withhold a reward it has not yet issued and reverse a reward already issued.
3.6 Where Touch Stay issues a reward in error, Touch Stay may reverse it.
4. Host rewards
4.1 A host reward is issued as account credit on the host's Touch Stay account and is applied automatically against the account's next invoice. Touch Stay issues host rewards monthly, for referrals that qualified in the preceding month.
4.2 Reward amounts are displayed in Touch Stay. They are set by Touch Stay, may differ by track and by the host's plan, may be set differently for an individual account, and are subject to change at any time.
4.3 Where the host is on the Free plan and has no invoice, Touch Stay holds the credit and applies it to the first invoice issued after the host activates a paid plan. Until then the credit has no value to the host.
4.4 Account credit is not redeemable for cash and is not transferable. Touch Stay holds it against the host's future purchases for as long as the host's account remains open. It is excluded from any refund calculation; where Touch Stay refunds a host, Touch Stay refunds only amounts the host actually paid. Where Touch Stay issues a final invoice on cancellation, Touch Stay applies any credit already earned to it. Credit that has not been applied when the account closes is not refundable and is not paid out.
4.5 A host on the Free plan earns a reward on the host track only. The guest track share is earned by hosts on a paid plan.
4.6 A host is responsible for any tax arising on a reward it earns.
5. The guest track — the host's position
5.1 Where the guest track is on, Touch Stay displays a referral invitation to the host's guests inside the guidebook. A host on a paid plan chooses whether to display it. A guidebook on the Free plan displays it at all times and the host cannot switch it off.
5.2 A guest who takes part contracts with Touch Stay under the Touch Stay Referral Program Terms and Conditions for Guests. The host is not a party to that arrangement, and the host is not an agent of Touch Stay.
5.3 Touch Stay decides what a guest is offered, whether a reward is available, and whether a guest's reward is paid. The host must not promise a guest a reward, state a reward amount other than the amount Touch Stay displays, or otherwise describe the guest offer in terms Touch Stay has not published.
5.4 The host must not claim, redirect or take a reward earned by one of its guests, and must not require or ask a guest to take part.
5.5 Touch Stay processes the name and email address of a guest who takes part, and decides how that data is used. The host does not receive the personal details of a guest who refers, or of a person that guest refers.
5.6 A host on a paid plan may switch the guest track off at any time. Switching it off removes the invitation from the host's guidebooks and stops new referrals from that point. A reward already earned is still issued, and a voucher a guest has already received remains valid. Where a guest made a referral before the track was switched off and the referred person converts to a paid subscription after that point, no reward is earned, for the guest or for the host.
6. Availability of rewards
6.1 Touch Stay funds a limited number of rewards, and may withdraw the reward offer at any time. The referral feature continues to work with no reward offer displayed, and no reward is due where no reward offer was displayed at the time the referrer obtained the link.
6.2 Where a host believes a referral qualified while a reward offer was displayed and no reward was issued, the host may contact Touch Stay within 60 days of the referred person's conversion. Touch Stay issues the reward where it verifies the claim.
7. Fair use
7.1 The following void any associated reward, and may lead to removal from the Program and to action on the host's account:
- self-referral in any form, including referring the host's own accounts, accounts the host controls, and coordinated exchanges of referrals between hosts;
- fake, duplicate or disposable-email accounts, and automated or scripted sign-ups;
- misrepresenting Touch Stay or the Program in order to obtain sign-ups;
- bulk unsolicited distribution of referral links by email, message or posting;
- bidding on Touch Stay brand terms in paid search, or presenting the host as an employee or agent of Touch Stay;
- breach of clause 5.3 or clause 5.4;
- any attempt to circumvent attribution or a fraud control.
7.2 A host must disclose that it stands to earn a reward when it shares a referral link in a public or commercial channel.
7.3 Touch Stay may require a host to verify their identity or eligibility before Touch Stay issues a reward.
7.4 Touch Stay may withhold, review, reverse or void a reward where Touch Stay reasonably suspects a breach of clause 7.1. Touch Stay tells the host the reason, and the host may ask Touch Stay to review the decision and will receive a reasoned answer. This clause does not affect the host's statutory rights.
8. Changes and ending the Program
8.1 Touch Stay may change these terms, the reward type, a reward amount, or the availability of rewards at any time. A change takes effect when Touch Stay publishes it and applies to every referral that has not yet been rewarded, including a referral already in progress.
8.2 A reward Touch Stay has already issued is not affected by a later change, except where clause 3.5, 3.6 or 7.4 applies.
8.3 Touch Stay may suspend or end either track, or the Program, at any time. A referral that has not been rewarded by the date the Program or the track ends earns no reward.
8.4 A change to these terms takes effect when Touch Stay publishes it and does not apply retrospectively. It does not affect a reward already issued, a discount already applied, or a referral already rewarded.
8.5 Touch Stay gives no notice of a change to these terms other than by publishing them. Where a host does not accept a change, the host may stop sharing referral links and, where the host is on a paid plan, switch the guest track off.
9. If the host was referred to Touch Stay
9.1 A host who created their Touch Stay account through a referral link receives a one-time discount on their first purchase. The discount is displayed with the offer and applies automatically to that purchase.
9.2 The discount is valid for 7 days from the day the trial starts. It is issued once for an account, it is not reissued after it expires, and restarting a trial does not produce another.
9.3 The discount does not repeat, does not apply to renewals or later purchases, has no cash value, and is not transferable. Only one discount applies to a purchase.
9.4 The discount is available once per person and once per payment method, and only to a person new to Touch Stay. It does not apply to an existing account holder, a reactivated account, or an account materially controlled by the referrer.
9.5 Whether the referrer earns a reward makes no difference to the discount.
10. Data
10.1 To run the Program Touch Stay processes the host's account data and referral activity, and the name and email address of a guest who takes part. Touch Stay handles that data under the Touch Stay Privacy Policy.
10.2 Touch Stay emails the host about the status of a referral the host made, and about a reward. Those are service messages about a referral the host started, not marketing. The host may opt out of them without losing a reward.
10.3 Touch Stay does not disclose the personal details of a referred person to the host. Notifications describe referral status only.
10.4 Where a Touch Stay account is closed, Touch Stay keeps a minimal record that the account existed, so that it can apply clauses 3.3 and 9.4 and prevent abuse of the Program. Touch Stay keeps no other data from a closed account for that purpose.
11. General
11.1 The Program is not a lottery, a sweepstake or a game of chance.
11.2 These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them. Nothing in these terms affects a host's non-excludable statutory rights.
11.3 Where these terms and the general Touch Stay Terms and Conditions conflict on a matter concerning the Program, these terms take precedence. The Limitation of Liability in the general Touch Stay Terms and Conditions applies to these terms.
